We provide a platform for viewing, selling, and purchasing original works of art, as well as for the commercial promotion and distribution of digital artworks through our website at www.queerart.es (the “Site”) and related services (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. ANY DISPUTES ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES WILL BE RESOLVED IN ACCORDANCE WITH SPANISH LAW AND SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF MADRID, SPAIN.

Queer Art reserves the right to modify or terminate the Services or these Terms at any time. Updates will be posted on the Site and reflected by the “Last Updated” date above. Continued use of the Services constitutes your acceptance of the revised Terms.

Seller Terms and Conditions

Responsibility for Works

As a seller, you are solely responsible for the artworks you list. You confirm that you own or have the necessary rights to the content and that it does not infringe any third-party rights.

Online Sales and Licensing

By listing works, you grant Queer Art a royalty-free, worldwide, non-exclusive, transferable license (with right to sublicense) to use, display, and promote those works in connection with the Services. Your compensation is limited to revenue shares on successful sales.

Purchaser Terms and Conditions

Purchasing Works

When purchasing through the Services, you buy directly from the artist, not Queer Art. Prices exclude shipping and applicable taxes. Transactions are processed by third-party providers. See our Return Policy for details.

Order Cancellations

We reserve the right to cancel any order due to errors, availability issues, or other reasons. You will be notified, and your payment will not be processed.

Taxes

All amounts are in Euros (€) and exclude VAT or other applicable taxes. Taxes will be applied according to Spanish law. Sellers are responsible for applicable tax obligations.

General Prohibitions

By using the Services, you agree not to post unlawful or offensive content, engage in unauthorized commercial use, or attempt to disrupt or compromise the functionality or security of the Services.

Termination and Account Cancellation

We may suspend or terminate your account if you breach these Terms. You may request account deletion at any time by contacting us here.

Compliance with Spanish Law

These Terms are governed by Spanish law. All disputes shall be resolved by the courts of Madrid, Spain, and in accordance with applicable national and EU legislation.
