These Terms of Service (the “Terms”) govern access to and use of the Queer Art website available at www.queerart.es (the “Site”) and its related features, including artist profile pages, editorial content, contact forms, and the Artist Portal.

The Site is operated by Asociación Queer Media (“Queer Art”, “we”, “us”, or “our”). By accessing or using the Site, you confirm that you have read and accepted these Terms. If you do not agree with them, you should not use the Site or the Artist Portal.

Please note: Queer Art is currently an informational and promotional platform. The Site is intended to showcase artists and their work, facilitate visibility, and help artists connect with their audience. The Site does not currently offer direct online sales, payment processing, order management, or shipping services.

1. Scope of the Service

Queer Art provides a digital platform through which visitors can discover artists, view artworks, access editorial or informational content, and contact the Queer Art team. Certain invited users may also access the Artist Portal to manage the visibility of their works, update public links, and submit requests related to their profiles or artworks.

2. No Online Sales or Distance Contracting

The Site does not currently function as an e-commerce marketplace. Any references to artworks, artists, visibility, or submissions are for informational, curatorial, or promotional purposes only. No purchase contract is formed through browsing the Site, viewing an artwork, or accessing the Artist Portal.

3. Access to the Artist Portal

Access to the Artist Portal is limited to users expressly authorized by Queer Art. Login credentials or access codes are personal and may not be shared with third parties. Users are responsible for maintaining the confidentiality of their access details and for notifying us promptly if they believe unauthorized access has occurred.

4. Acceptable Use

You agree to use the Site lawfully, in good faith, and in a manner that does not harm the Site, Queer Art, participating artists, or other users. In particular, you must not:

  • use the Site for unlawful, abusive, fraudulent, defamatory, or misleading purposes;
  • attempt to gain unauthorized access to restricted areas, user accounts, or server resources;
  • copy, scrape, reproduce, republish, or exploit Site content beyond what is permitted by law or by our prior written authorization;
  • upload or submit content for which you do not hold the necessary rights or permissions;
  • interfere with the operation, security, or integrity of the Site.

5. Artist Content and User Submissions

Artists and other contributors remain responsible for the content, materials, links, and information they submit or request to be published through Queer Art. By submitting content, you represent that you hold the necessary rights to use and share it and that such content does not infringe third-party rights, including intellectual property, privacy, image, or moral rights.

By submitting materials for publication, display, or promotion on the Site, you grant Queer Art a non-exclusive, revocable, worldwide right to host, display, reproduce, adapt for formatting purposes, and promote those materials in connection with the operation and promotion of the Site and Queer Art’s activities, unless otherwise agreed in writing.

6. Intellectual Property

Unless otherwise indicated, the Site design, text, branding, layout, database structure, and original editorial materials are owned by or licensed to Queer Art and are protected by applicable intellectual property laws. Artwork images, artist names, biographies, and related materials may belong to the respective artists or rights holders.

No transfer of intellectual property rights occurs through access to the Site. Any reproduction, distribution, transformation, public communication, or other use beyond legally permitted use requires prior authorization from the relevant rights holder.

7. External Links and Third-Party Services

The Site may contain links to third-party websites, social media profiles, embedded forms, or external services. These links are provided for convenience only. Queer Art does not control and is not responsible for the content, availability, security, or privacy practices of third-party services.

8. Availability and Disclaimer

We make reasonable efforts to keep the Site accurate, secure, and available, but we do not guarantee uninterrupted availability or the complete absence of errors. The Site and its contents are provided on an “as is” and “as available” basis, within the limits permitted by applicable law.

Queer Art may update, suspend, restrict, or remove any part of the Site, any artist content, or access to the Artist Portal where necessary for operational, editorial, security, or legal reasons.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Queer Art shall not be liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the Site, nor for decisions made on the basis of information available on the Site, nor for the acts or omissions of artists, visitors, or third-party service providers.

Nothing in these Terms excludes or limits liability where such limitation is not permitted under applicable law.

10. Privacy, Cookies, and Personal Data

The processing of personal data through the Site is governed by our Privacy Notice and, where applicable, our Cookie Notice. Personal data will be processed in accordance with applicable data protection law, including Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

11. Changes to These Terms

We may update these Terms from time to time to reflect legal, technical, editorial, or operational changes. The updated version will be published on this page together with the revised “Last Updated” date. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

12. Applicable Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with Spanish law, including, where applicable, Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), Regulation (EU) 2016/679 (GDPR), and Organic Law 3/2018 (LOPDGDD).

Any dispute relating to the Site or these Terms shall be submitted to the courts and tribunals that are competent under applicable law. If no mandatory rule provides otherwise, the parties submit to the courts of Madrid, Spain.
