Who operates the service

Queer Art is an independent online gallery operated by Asociación Queer Media, Calle de Granada, 10-6C, 28007 Madrid, Spain (“Queer Art”, “we”, “us”). These Terms govern the website, Artist Portal, community features, artwork submissions, editorial content, contact forms and paid promotion service.

By using a restricted feature or purchasing a service, you agree to these Terms. Visitors may browse public pages without creating an account.

Open Calls and artist selection

New artists are considered through Open Calls announced on the Open Calls page. Sending an application does not guarantee selection or publication. Queer Art may assess artistic quality, relevance, rights clearance, technical suitability and curatorial fit.

Selected artists receive access to the Artist Portal. Queer Art may decline or postpone a submission and will not publish artist-supplied material before moderation.

Artist Portal and community

Portal access is personal to the approved artist. Artists must keep access to their email account secure and promptly report suspected misuse. The Portal may be used to add or edit artworks, request publication or hiding, manage profile links, view approximate visit statistics, and communicate with other participating artists.

Community messages must be lawful, respectful and relevant. Harassment, hate, threats, impersonation, spam, unlawful sexual content, malicious files and infringement of another person’s rights are prohibited. Queer Art may restrict access or remove material for legal, safety, curatorial or operational reasons and will explain a moderation decision where applicable.

Artwork, rights and licence

Artists retain ownership of their artwork and other original material. By submitting material, the artist confirms that they control the rights and permissions needed for publication, including copyright, privacy, image and moral rights.

The artist grants Queer Art a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format, display and promote the submitted material only for operating and promoting Queer Art and the artist’s presence on it. The licence lasts while the material is published or reasonably needed for records, dispute handling and lawful backups. It does not transfer ownership.

Artist of the Month promotion

The promotion is a one-time service priced at €50. It starts after Stripe confirms payment and normally runs for 30 consecutive days. It does not renew automatically. If several artists have active promotions, the homepage placement rotates between eligible artists when the page is loaded. Artwork order may also vary.

The service promotes visibility, not a guaranteed number of views, enquiries, sales or professional outcomes. The artist must have an eligible public profile and at least one publishable artwork.

If you buy as a consumer, mandatory consumer rights remain unaffected. Where the statutory 14-day withdrawal right applies and you ask us to start the service immediately, you may withdraw through the contact form; you may be charged a proportionate amount for service already provided. Refunds for duplicate charges, technical failure or other legal entitlements are handled individually.

Acceptable use

You must not attempt unauthorised access, disrupt security, introduce malicious code, scrape the Site in a way that harms its operation, use another person’s identity, submit deceptive information, or use content beyond the permission of its rights holder. Reasonable indexing by search engines is permitted.

Moderation, suspension and appeals

Queer Art may reject, unpublish or restrict content or accounts where material breaches these Terms, appears unlawful, creates safety or rights risks, or no longer fits the gallery’s curatorial programme. Where appropriate, the affected artist will receive a reason and may ask for human review through the contact form. Urgent restrictions may be applied before review when necessary to limit harm.

Availability and third parties

We work to keep the Site accurate, secure and available, but maintenance, technical faults and third-party services may cause interruptions. Links and embedded services are governed by their own terms. We may change or discontinue features where reasonably necessary.

Responsibility and liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights. Within the limits allowed by law, Queer Art is not responsible for indirect loss, third-party conduct, or decisions based solely on website information. Artists remain responsible for their submissions and dealings initiated outside the Site.

Law, changes and contact

Spanish law applies, without depriving consumers of mandatory protections of their country of residence. Courts are determined by applicable mandatory rules; otherwise the courts of Madrid have jurisdiction.

Material changes will be dated on this page and, where they significantly affect registered artists, communicated through an appropriate channel. Questions or complaints can be sent through the contact form.
